Hi Christof,
Two pronged question, answered accordingly:
- By definitions we “are close” with NXL residing in our Hitlist. Watch for alerts on this one!
In terms of shareholder class actions, they have to be considered on their individual merits and by definition risks to the share price.
- NXL is currently involved in a consolidated class action in the Supreme Court of Victoria. The proceedings allege that Nuix engaged in misleading or deceptive conduct by making false representations or omitting crucial information in its Initial Public Offering (IPO) prospectus and subsequent market statements.
We feel that some people at NXL will be found to have acted unethically/misleadingly in its early days but this isn’t a new story, and investors should be evaluating the business as it stands today. Generally, class actions are not big influences on current/future share prices.
